How New York Calculates Child Support

New York's Child Support Standards Act (CSSA) provides a formula-based approach to calculating child support. The formula applies a percentage to the combined parental income up to a statutory income cap (currently $163,000), with discretionary consideration for income above that threshold.

The applicable percentages are: 17% for one child, 25% for two children, 29% for three children, 31% for four children, and 35% for five or more children. The non-custodial parent pays their proportionate share of the total calculated amount based on their percentage of combined income.

How New York Calculates Spousal Maintenance

New York's spousal maintenance guidelines provide a formula-based approach for determining the amount of maintenance. The simplified formula calculates 30% of the payor's income minus 20% of the payee's income, subject to the requirement that the payee's income plus the maintenance award does not exceed 40% of combined income.

The duration of maintenance is guided by the length of the marriage. Courts use general ranges: marriages of 0–15 years may result in maintenance for 15–30% of the marriage length; 15–20 years for 30–40%; and 20 or more years for 35–50%. These are guidelines — courts can deviate based on the circumstances of the case.
